FCC Releases Controversial Open Internet Order; Declares Broadband Internet Access to be Title II Telecommunications Service

March 12, 2015 This morning, the FCC released a 400 page Order adopting three “bright line” Net Neutrality rules and a declaratory ruling and order that reclassifies broadband Internet access service as a “telecommunications service” subject to Title II of the Communications Act, while exercising its forbearance authority with respect to 27 out of the 48 provisions of Title II and 700 associated FCC regulations.

FCC Reclassifies Broadband Internet Access Service as Title II Common Carrier Service; Imposes Net Neutrality Rules, Enhanced Transparency Requirements

March 3, 2015 On February 26th, the FCC adopted an Order that, among other things, reclassifies broadband Internet access service from a lightly regulated Title I “information service” to a more heavily regulated “telecommunications service” subject to Title II of the Communications Act, in the process creating significant new compliance obligations for broadband Internet service providers (ISPs).

FCC Adopts New Forfeiture Methodology for Companies Failing to Timely Contribute to USF and Other Programs on Time

February 13, 2015 On February 3, 2015, the FCC released a Policy Statement adopting a new method for fining telecommunications service providers who fail to timely contribute to many Federal programs. Under the new method, the FCC will set the base forfeiture amount at triple the amount a company owes.

More Funding Available for Schools and Libraries Broadband Program E-Rate Application Window Open through February 26

January 30, 2015 Last December, the FCC adopted an Order updating its E-Rate program by increasing available funding improving the effectiveness of the program. The Order increases the E-Rate budget to $3.9 billion annually each year through 2019. The application window is open through February 26, 2015.

Reminder: Certifications Due Today, Monday, December 15th in FCC’s Special Access Data Collection

December 15, 2014 All companies that were required to file a Form 477 for 2013 must respond to the FCC’s one-time Special Access Data Collection. Companies that do not fall into one of the FCC’s three specified filing categories must file a certification to that effect by today, Monday, December 15, 2014.

FCC Special Access Data Collection Certifications Due December 15th Deadlines for Data Responses Extended

December 4, 2014 All companies that were required to file a Form 477 for 2013 must respond to the FCC’s one-time Special Access Data Collection. The type of response required will depend on each company’s reporting category. Responses for companies not falling into specially-designated categories are due December 15. Other companies falling into these categories will be required to respond by January 29, 2015 or February 27, 2015, depending on their size. This update provides additional information to help companies determine the type and timing of response required.
